Police are preparing to press a premeditated-murder charge against a 20-year-old man who swerved his Mercedes-Benz car into a crowd of people on a footpath in Bangkok shortly after he attacked a bus driver with a rock on Wednesday night.

The incident critically injured three people, one of whom died yesterday.

The driver was identified as Kanpitak Pachimsawas. He is a son of former Miss Thailand Savinee Pachimsawas, 42, and Kan-anek Pachimsawas. Kan-anek's elder brother is Lt-General Ukrit Pachimsawas, a former assistant commissioner of the Royal Thai Police.

The woman who died was Saichon Luangsaeng, 42, an official of the Bangkok Mass Transit Authority.

"Doctors said the vehicle pressed over mum's chest and torso. Her ribs were broken and they pierced into her internal organs. Her pelvis was broken into pieces," said Saichon's daughter, Sucheera Insuwan, 25. "I am shocked. I never thought mum would face such violence. I am going to fight for justice."

Sucheera said Saichon's body would be donated to the Red Cross Society in accordance with her mother's wishes.

"We will ensure justice for both sides," Metropolitan Police commissioner Lt-General Adisorn Nonsee said yesterday.

He said investigators at Thonglor police station were preparing to charge Kanpitak with premeditated murder, attempted murder and physical assault.

Kanpitak was taken to Samitivej Hospital following the incident.

After he swerved his car into the crowd and ran over three victims, witnesses attacked him. As of yesterday, Kan-anek said his son was crying all the time and was depressed.

"He has suppressed his feelings since he was young. He often became stressed out and hospitalised," Kan-anek said.

The father said his son had recently lost consciousness and was sent to hospital. "He has suffered from stress relating to his girlfriend and his mum," he said.

He said he had taken care of Kanpitak from Monday to Friday, while Savinee had taken care of him on weekends. "From now on, I won't let my son drive. He will also enter the monkhood in dedication to his victims," Kan-anek said.

The father also expressed deep condolences to the victims and offered to compensate them.

Adisorn reckoned that Kanpitak had an underlying disease that made him unable to control himself.

"We have to check his health history and interrogate doctors," Adisorn said.

Galaya Rajanagarindra Institute director Dr Sirisak Thitidilokrat said Kanpitak had paid three visits to the institute as an outpatient.

"The first time was on March 9 and the last time was in April," he said.

However, Sirisak declined to disclose any further details because he needed to protect the patient's rights. The institute treats people with mental problems.

On Wednesday night, Kanpitak complained to Pol Sgt-Major Nukool Dechaphan that a bus had brushed against his sedan. "I flagged down the bus," Nukool said.

The bus stopped and Nukool was about to examine the vehicles when he heard Kanpitak fighting with bus driver Sathaporn Arunsiri, 37.

Sathaporn yesterday testified to investigators at Thonglor police station that he was checking on the Benz sedan when Kanpitak banged his face with a rock.

"I became groggy and then saw the man banging his Benz into the crowd," Sathaporn said.

The bus driver insisted that his vehicle did not brush with Kanpitak's luxury car. He believed the young man might have misunderstood what had happened.

"I have been driving for seven years and I have never been involved in any accident," Sathaporn said.

Fare collector Somjit Klaewkla stood by Sathaporn's account. "Our bus didn't do anything. There was no brushing accident," she said.

She said some passengers pointed their fingers at Kanpitak and used their camera phones to photograph his face after they were asked to get off the bus.

When a bus is involved in an accident, passengers have to get off and wait for a new bus to come.

"I believe the man got angry and therefore swerved his car into where we were standing," Somjit said. She said she had sustained only minor injuries.

Another survivor, Ratchanee Jiew, 58, also said the bus did not brush against any vehicle.

Sathaporn also told police that a man, who identified himself as the father of the car's driver, threatened to harm his wife and children.

"He said he knew many senior police and military officers. The threat was made in front of police officers. I am scared," Sathaporn said.

Oh poor baby, the child has developmental problems...the parents say. His only problem is that he's a fucking spoiled little shit. What kind of parents would give a deranged child a Mercedes to drive around in anyway?

I just hope the Thai system won't let him off the hook, just cuz he's well connected. Doesn't matter if he's sick in the head, drunk, or on drugs. It's totally inexcusable. He needs to be thrown in the slammer.

His parents say he has mental problems and all of that. I think his parents should be charged along with their son for spoiling the brat enough that he becomes mentally retarded.

So he is going into monkhood for his victims huh? I guess he won't spend a day in jail with all that money and upper class links from his parents.

Damn I wish I had so much money that I became metnally ill with all that bad money.

I share quite a lot of Doseiai's indignation on this. Just about every night I listen to folks like this doing wheelies at about three o'clock in the morning and keeping everyone awake with their bass-bins. The attitude of the father says it all:

My son has problems, but if I were to admit he is crazy it would be loss of face for my glorious family. In the meantime, I cannot be bothered to impose any kind of discipline on him, such as stopping him from driving. Discipline is for the sons & daughters of the masses only. And by sending him to a temple he will avoid having to take responsibility for any of his actions.

The rock in the face and the father's threats to invoke his military and police chums says it all. As for the policeman who said he would ensure justice for both parties, I would suggest it would have been better if he had forgotten to mention justice for this punk. It seems to me he has already received more than his fair share of justice. Real punishment is essential. If that means imprisonment in an establishment for the criminally psychiatric, then so be it. Craziness has an even bigger stigma than criminality here.

From Thai Rath (http://www.thairath.com/offline.php?section=hotnews&content=52998), the family seem to be going with the argument "he can't control himself" which they seem to be hoping to use to get the son off criminal charges. Then, if this was the case and he was receiving medical attention, why was he not committed? Why was he also allowed to drive? The victim's family want justice and there appears to be plenty of witnesses and evidence. This is a clear-cut case of murder.

I'd like to know what other people think about this. I have a sort of hunch that once Sucheera is contacted by this family, any moves that she makes towards even the slightest form of reconciliation will endanger her chances of ever receiving true justice in this case. I would be very tempted to throw any proffered money back in their faces, but then I'm not the one who has to live with the emotional and financial results of this crime. Sucheera was naturally demanding justice last night, but the true consequences are probably beginning to sink in right now. And doubtless this is what the criminal's family are hoping for. Let's hope that there are those who will give Sucheera the support and advice she needs to stick to her initial demand for justice:

Victim's Family receives no contact from the wealthy Pachimsawas


The Pachimsawas Family has yet to contact the daughter of a woman killed by their son.

Kanpitak Pachimsawas, 20, swerved his Benz sedan into a crowd of people on footpath on Wednesday's night, critically injuring three people. One of them, Saichon Luangsaeng, died on Thursday.

Saichon's daughter Sucheera Insunawan, 25, Friday said the wealthy Pachimsawas Family did not contact her since the incident took place. Saichon's cremation will be held on Sunday.

Saichon was a single mother.

She has worked hard to support her family. Sucheera, a fresh graduate, said she was so disoriented and did not know what to do now.

Father of Benz driver warns he will take legal action

The father of a 20-year-old man who killed one person and seriously injured three others when he drove over them in his car has hit back with threats of legal action against bystanders.

Kan-anek Pachimsawas yesterday vowed to take legal action against people who damaged his son's Mercedes-Benz vehicle after he had driven into them at a bus stop near Sukhumvit Soi 26 on Wednes-day evening.

One of the victims of the incident died on Thursday and three others remain in critical condition.

The incident occurred after Kanpitak apparently became angered by a bus driver following a traffic altercation. A rock was thrown at the bus driver.

Nine victims made police complaints against the driver, Kanpitak, the son of former Miss Thailand Savinee Pakaranang.

But Kan-anek yesterday threatened legal action of his own. He offered rewards for any witness who captured the alleged deliberate damage to the vehicle on video or mobile-telephone camera.

He insisted the incident was the result of a disease suffered by his son and told television news later that an "uneducated and low-class person" had incited the incident.

The story prompted Internet users to post scathing attacks at popular chat sites, many of them directed at Kan-anek.

"I will compensate the victims as deemed necessary and appropriate. But the compensation amount must not be too much," Kan-anek said later.

He added that his son was unable to move his legs because of thrombosis. Kanpitak is currently in Samitivej Hospital.

"My son is so sad he told me he wanted to die," Kan-anek said. He added it was as if his son had been possessed at the time of the fatal act. "He's a man with a kind heart," the father added.

Savinee will attend the funeral of victim Saichon Luangsaeng, but Kan-anek will not go "for safety reasons". "I just gave a television interview and used harsh words," he said.


Kanpitak accuses the bus of scraping his luxury car. Following his throwing of a rock at the driver, passengers were asked to leave the bus. When they blamed Kanpitak for the inconvenience and rock-throwing incident, he allegedly drove his car into the crowd.


The bus driver initially maintained there had been no collision but tests show the two vehicles had made contact.


However, Thonglor police maintain the incidents are separate. Superintendent Colonel Jirapat Phumisit said 10 witnesses had been questioned and police would soon interview Kanpitak.


"However, we are yet to get permission from his doctors," Jirapat said.


According to Kan-anek, the doctor who treated Kanpitak at the Galaya Rajanagarindra Institute earlier this year is overseas and yet to explain the young man's condition to investigators. The institute treats people for mental problems.

Saichon's daughter Sucheera Insunawan, 25, is finding it difficult to accept her mother's death.

"He [Kanpitak] should apologise to my mother. If he comes, I can forgive him and I believe my mother will forgive him too," she said.

The recent university graduate said she now had to take care of the family's condominium mortgage and her 15-year-old, mentally disabled cousin.

Department of Land Transport to increase driver license testing regulations
The Department of Land Transport is preparing to increase testing regulations for driver's license issuance.

The Director General of the Department of Land Transport Mr. Silapachai Charukasemrattana (ศิลปชัย จารุเกษมรัตนะ) reported on the incident in which Mr. Kanpitak Pachimsawas (กัณฑ์พิทักษ์ ปัจฉิมสวัสดิ์ ), the son of former Miss Thailand Savinee Pachimsawas, drove his vehicle into a crowd of bus passengers, resulting in 1 fatality and 2 critical injuries. Mrs. Savinee alleged that her son had psychiatric issues.

The Director General of the Department of Land Transport said that the incident has increased public awareness of the necessity for more rigorous driver license testing. Mr. Silapachai affirmed that land transport officials will conduct revision of testing regulations for private and public motorists, especially in areas of health tests. Physician reports of motorist capabilities will also be accepted only from state hospitals, rather than private clinics.

I have just watched the TV interview that the father gave. It was extraordinary, the number of times he used the phrase "uneducated and low class person". The talk of the damage to the Mercedes Benz which was shown was apparently a scratch on off the door mirrors which was not visible on TV, but there was a trace of paint. I still can't get over this:

This father is an idiot. He makes a bad example of how someone that is not uneducated or low class can make a fool of himself and his country. He is a prime example of how prehistoric this county is. A son can kill a person but a father can file a lawsuit for damage to his mercedes in the process. I guess his car is worth more than a low class uneducated person.

If the daughter of the victim takes the money I think is much better than not. I do not think she can win in a court. This policeman probably will pay millions of baht to lawyers and policemen to alter the evidence and has his kid aquitted do to some technical error. Then she will get nothing in return.

"I will pay compensation as long as its not too much money." What the heck is he saying? I can't believe how stupid and uncaring this guy is.

If a vigilante mob were to attack this guy I sure will join them.

Road-rage bus killer to be arrested

(BangkokPost.com) - Court allowed the issuance of arrest warrant against a son of a former Miss Thailand winner who rammed his car into bus passengers on Thursday.

Kanpithak Patchimsawat, 20-year-old son of Sawinee Pakaranang, is charged with murder and attempted murder after he ran over several bus passengers with his car, killing one and injuring a number of others.

Police at Thong Lor station will go to question Mr Kanpithak at Samithivej Hospital in the afternoon.

Police said they have completed their questioning of almost all eye-witnesses except three critically injured passengers who are in emergency rooms.

In this instance, it is not just about Sucheera. Three others were seriously injured and a number of people were injured. This would involve having to pay all of them off which I think given the father's statements is unlikely.

Also, from Thai Rath, Kanpitak was not alone in the car as he was there with his younger sister, who has conveniently flown to Australia to compete in a ballet competition. Apparently, she will tell what the bus driver did to her brother. One wonders if Kanpitak was so mentally unstable and unable to control himself, who was at fault for the scratch on his car?

The accident happened at the beginning of Sukhumvit Soi 26. It was a black Merc with the license plate ศศ 6699.

The father also says that don't believe that rich people can know get off as is it is not like the past, but then says whether is son is prosecuted will all depend on what the doctor says about his son's mental capacity. Hmmm.

Driver apologises to victims
Arrest warrant for murder and assault served on Kanpitak in hospital

Kanpitak Pachim-sawas yesterday apologised to his seriously injured victims for the first time since he swerved his Mercedes-Benz sedan into a crowd of people on a Bangkok footpath on Wednesday night.

The 20-year-old man expressed his remorse on the same day the court issued an arrested warrant for him on three grave charges - premeditated murder, attempted murder and assault and battery.

The notice was delivered to him at Samitivej Hospital, where he was undergoing treatment for injuries.

The apology came to the public in the form of brief note he wrote to Saengmanee Imsolary - one of the injured - at Camillian Hospital. It was passed to Saengmanee together with a bouquet by Kanpitak's mother Savinee Pakaranang, a former Miss Thailand.

"To Khun Saengmanee and family, I deeply regret the devastation to your lives caused by my action. I apologise, Ham," said the note. Ham is his nickname.

The message became the first time the young man, claimed by his family as having mental problems, had communicated with the victims since he ploughed into them.

Savinee said Kanpitak was worried about them and wanted to say he was sorry directly himself, but he could not get out of his hospital bed due to thrombosis in his legs.

He was wounded as angry bystanders attacked him for killing one person and seriously hurting two with his Benz.

"Ham does want to take action against those who assaulted him. I want everyone to listen to his own words when he gets well. I beg the media to justify him," Savinee said.

Her words contradicted what Kanpitak's father Kan-anek said on Friday, that he would take legal action against those who had damaged the Benz and hurt his son.

Colonel Jirawat Phumijit, superintendent of Thonglor police station, said he would discuss with doctors a good way to detain Kanpitak while under arrest.

Families of victims have gradually reported to police to demand compensation from Kanpitak and take legal action against him.


Representatives of Nam Song Hotel in Laos, where Laotian Saengmanee worked, reported to investigators at Thonglor police station, determined that they wanted to take criminal action against Kanpitak.

Saengmanee is still in serious condition with three broken ribs and a big wound on her back.

Wisit Wisitsora-at, director of the Justice Affairs Office under the Justice Ministry, offered assistance to victims and families who had difficulties in taking legal recourse against Kanpitak. He said the Justice Fund under his office could provide financial support.

While being condemned by the public as a "spoiled hi-so brat", Kanpitak has also received moral support from his fan club. A website www.moohamfanclub.th.gs was launched to "protect and give moral support" to Kanpitak. However, the website was open for public comment for just several hours.

At noon, Kanpitak's fan club decided to shut down the site as too many messages censuring Kanpitak were posted.

Mum faints at daughter's funeral

Samut Prakan _ The 68-year-old mother of the woman killed when a man drove his car into a crowd at a bus stop fainted at her daughter's funeral yesterday after hearing a message of condolence from the driver, read to her by his mother. Thongkham Luangsaeng was rushed to hospital after hearing the message from Kanpithak Patchimsawat, 20, who yesterday denied police charges of premeditated murder, attempted murder and physical assault.

Hundreds of mourners packed Thong Khong temple to bid a final farewell to Saichon, a 42-year-old financial officer with the Bangkok Mass Transit Authority. Mr Kanpithak's mother and former Miss Thailand, Mrs Sawinee, arrived with the note and a garland to express her sorrow.

Mrs Sawinee refused to disclose the content of the note and said her son was not mentally or physically capable of attending the funeral.

She said Mr Kanpithak was very stressed and his condition had worsened. She placed sandalwood flowers at the casket and left before the cremation.

Mr Kanpithak was taken to Samitivej Hospital after the incident on Wednesday, when he drove his car into a group of bus passengers after an argument with the bus driver.

His father, Mr Kan-anek, said he would put up land worth about 800,000 baht to bail out his son today instead of using the position of Mr Kanpithak's uncle, former assistant national police chief Pol Lt-Gen Ukrit Patchimsawat, as earlier planned.

Three victims remain in hospital with serious injuries. One of them is Saengmanee Imsodari, a manager at the Nam Song Hotel in Laos. Her French employer has filed separate criminal and civil charges against Mr Kanpithak.

Doctors said Mrs Saengmanee was on a respirator and severe injuries to her pelvis meant she would not walk normally again.

A top police official said police would take a month to wrap up the charges and then seek prosecution.

Normally, in a case of hi-so against ordinary people, I think the hi-so would easily win. I think this may be a precedent...there were simply too many witnesses. I mean, this guy literally plowed into and over a crowd that just got off the bus. Plus, there is the media coverage. :)

My god, I mean, hitting the bus driver with a rock on the head over a minor scratch is bad enough. But this is above and beyond anything I've ever seen.

What pisses me off is that the mother keeps mentioning that her son is "stressed". Those parents need to wake up smell reality...they aren't getting off the hook that easily now. Of course he's stressed, he f**king purposely killed someone, seriously injured 3 others, and a huge crowd saw it. Duh! I'd beat the hell out of her right now, I don't care if she is MISS THAILAND.

Funny thing is, this kind of thing is not limited to this act. It seems to be a pattern, unfortunately.

I have a farang friend in Taiwan, who has to carry a baseball bat in his car. Why? Because he's been threatened with bats by hi-so jerks on the road, who don't follow any rules. He is the only one enforcing, as police do nothing. It all comes down to the police not doing their job...Paris Hilton learned, even she can't ignore the law!

This is not a case of the Thai system sucking. A system is what u make of it. If you don't put pressure, if you don't fight for what u believe, of course powerful people will just run u over, literally. Powerful people will always challenge any system. Look at Erin Brockovich vs PG&E, it still happens in USA despite our rule of law. As residents of Thailand, we need to own up to our system. Is this how we want things to be?

Let's make a precedent for these people by not letting them off lightly.

Son of ex-Miss Thailand granted bail

Police granted on Monday temporary bail to Kanpitak Pachimsawas, the man accused of killing one woman and injuring 10 other people by driving his car into a crowd of people on a Bangkok footpath.

His mother Savinee Pakaranang, a former Miss Thailand, submitted title deeds for land in Bang Na worth Bt6.39 million for his bail release.

The woman who died was Saichon Luangsaeng, 42, an official of the Bangkok Mass Transit Authority. Kanpitak faces charges of premeditated murder, attempted murder and assault and battery.

Savinee said she and her 20-year-old son were sorry for what happened. Kanpitak had wanted to attend Saichon's funeral but Savinee stopped him due to his injured condition.

She said the family was willing to pay compensation as requested.

Metropolitan Police Division 5 commander Anant Srihiran said police granted bail to Kanpitak because Savinee provided the title deeds and police had to wait for testimonies from the 10 injured people.

Anant said Kanpitak initialฌly denied all charges. He said Kanpitak's senior police official relative had not contacted him for help and insisted the case would proceed on the evidence. He also said he had not yet heard from Kanpitak's father Kananek, who said on Friday that he would take legal action against those who had damaged his son's Mercedes Benz car and hurt his son.

Later yesterday, deputy Bangkok police chief Maj General Jate Mongkholhatthee said police were waiting for experts' opinions about Kanpitak's reported illness.

If Kanpitak was deemed to have no self control at all when he swerved his car into the crowd, he would not be prosecuted, Jate said, but if he was deemed conscious and had no such illness, he would face legal action as an ordinary wrongdoer.

Jate declined to comment as a police investigator about how it was possible for Kanpitak to have no consciousness of his actions when he pursued a bus, which he claimed brushed his car, from Soi Nana to the scene of the tragedy at Sukhumvit Soi 26. However, he offered his personal view that he did not believe it was possible.

In the meantime, teacher Yanisa Tojuan, wife of Manote Tojuan, 36, a victim who remains in Kluay Nam Thai Hospital's intensive care unit, said her husband's injuries would take six months to heal.

Urging Savinee to directly express sincerity to assist and compensate the family rather than talking to the media, she said she would proceed with legal action on behalf of Manote.

Meanwhile, Kananek yesterday gave a wai to apologise for his earlier comments to an upset crowd in the lobby at Samitivej Hospital, where his son is being treated.

He told reporters that his son's injuries meant it would be several days before he could be released from hospital. Kanpitak was depressed and feeling sorry about the death and injuries - so much so that he sometimes became overstressed, screamed and passed out.

He said his son's symptoms had become severe in the past three months. Asking for sympathy from all sides because his son was hurt mentally and physically, Kananek said his remarks on Friday had stemmed from his fury on overhearing people saying his son was faking a seizure.

Last Wednesday night, after he had attacked a bus driver with a rock, Kanpitak swerved his sedan on to the footpath. Three people were critically injured and Saichon died the next day.

Bus union may sue Benz driver for libel
The Bangkok Mass Transit Authority union yesterday threatened action for criminal defamation against a murder suspect who drove his car into a crowd, killing an employee.

It accused the man's father, too, for a statement in which he described bus employees as "uneducated and low-class". He had claimed a bus driver and conductor were involved in a brawl with his son before the fatal incident and that a No 513 bus had collided with his son's Mercedes-Benz car.

Union president Sanan Bun-ngok said the statement by Kan-anek Pachimsawas in a television interview was unacceptable, false and had damaged the reputation of authority employees in the eyes of the public.

He said Kan-anek and suspect Kanpitak, 20, had damaged the reputation of authority employees, including the female staff member killed in the incident.

Before Kanpitak drove his car into a crowded bus stop in the Sukhumvit Soi 26 area, he allegedly verbally and physically assaulted the two employees.

"Education alone doesn't make people good. It's the deeds they do," Sanan said.

Meanwhile, Bangkok police chief Adisorn Nonsee said yesterday that Kan-anek must pay compensation to victims.

Last week Kanpitak, 20, the son of former Miss Thailand Savinee Pakaranang, drove his car into a bus stop after an altercation with a bus and its driver. One person died and several were badly injured.

Adisorn said police expected to start interviewing Kanpitak about the event next week. Waiting a month to question him over a murder charge "would have been too long".

"The one-month period could have aroused suspicion or prompted uneasiness among officers handling the case," he said.

The family of Kanpitak and his lawyer and psychiatrists welcomed questioning of the suspect, he noted.

Adisorn instructed Metropolitan Police Division 5 commander Maj-General Anant Srihiran, the officer in charge of the case, to ensure the family of the woman killed in the incident and those injured were compensated.

Meanwhile, Savinee visited and apologised to Hathaithip Krunthakhajorn, a University of the Thai Chamber of Commerce student from Samut Prakan, who was injured in the incident.

Savinee said she had only recently learned of Hathaithip's treatment in hospital and had agreed to cover all expenses.

Three of four bus-rage victims recovering


(BangkokPost.com) - Three of the four victims critically injured when 20-year-old Kanpithak Patchimsawat rammed his Mercedes into a row of bus passengers following a quarrel with the bus driver are said to be recovering in hospital.

Doctors at Kluai Nam Thai and Vibharam hospitals said that two of the patients with fractured bones will make a full recovery within a couple of months. Another patient suffering from infections on his ankle and thigh was also described as making good progress.

Medical experts, however, are still closely monitoring the condition of Saengmanee Imsodari, being treated at Camillian hospital. She is still being fed intravenously and is breathing with the aid of a respiratory apparatus. She will undergo another operation later Wednesday.

Meanwhile, the union of the Bangkok Mass Transit Authority (BMTA) plans to sue Mr Kanpithak's father after he called the staff "uneducated" and "lower-class people."

Union president Sanan Boon-ngork said the staff received training in manners and providing service, and the accusation defames BMTA.

Kan-anek, father of Kanpitak, was interviewed hugely popular news programme “Ruang Lao Chao Nee" about an incident in which his son allegedly rammed his car into a row of pedestrians, killing one and critically injuring several others.

In the course of the interview with prominent news analyst Sorayut Suthasanajinda, Kan-anek said a bus conductor who claimed his son had run over the pedestrians on purpose was “from the lower rung of society and therefore lacked the proper education to understand what really happened.”

Kan-anek insists his son has anger management problems and "blacked out" shortly after he was involved in a brawl with the bus driver. Moments later, he drove his car into passengers who had alighted from the same bus.

A BMTA representative has discussed the matter with a Channel 3 executive and handed a letter of complaint to Channel 3. The letter called on the station to exercise caution when broadcasting live interviews in the future and to filter material deemed as “offensive” and “derogatory”.

The Channel 3 representative vowed to bring up the matter with senior executives at a meeting.

Kan-anek apologizes to BMTA officials

The father of Kanpitak Pachimsawas, the 20-year-old man who ran over a row of pedestrians, killing one in a "bus rage," has apologised to Bangkok Mass Transit Authority (BMTA) staff for offending them during a television interview aired on Channel 3.

Kan-anek insists he was speaking out of anger and out of concern for his son's condition at the time of the interview.

During the live broadcast, Kan-anek accused a bus conductor of "lacking education" and coming "from the lower-class" for telling police his son had run over people with his car "on purpose".

"I just wasn't thinking when I said those offensive remarks. I have come here today to offer my sincere apologies to all BMTA staff. I don't expect you to forgive me straight away, but I do hope you understand that whatever I said, I did so out of anger at the time.

"I was very stressed after I was told what had happened. I only hope that you will eventually forgive me for what I said," Kan-anek said.

He also said that he won't be filing any charges with regards to those who attacked his son immediately after the incident.

"There will be no charges filed. I'd like to ask for your forgiveness and hope we can all put this case to rest today," he concluded.

Nick Bracks will be charged on summons with drink-driving after crashing the family car near his Williamstown home on July 13.

Police say he had a blood-alcohol reading of .129 and his friend Huw Wilson, a passenger in the car, needed hospital treatment for cuts.

The premier said he was shocked and surprised by the incident, but believed his son had learnt from it.

"I didn't see this coming. It wasn't what I thought was in the character of Nick," Mr Bracks told Southern Cross Broadcasting.

"(But) he's learnt by this. He's obviously accepted that this could've been even worse than it was.

"He could've injured or harmed someone else, either some innocent person on the road or someone else in the car and it could've had a profound effect forever."

Mr Bracks said his son would be made accountable for his actions through the justice system.

"He has been suspended, he's going to have to adjust to that and that's how it should be and any other remedy the court applies as well. He's also got the public admonishment," he said.

Mr Bracks said the family would rally around the young man.

"We'll certainly give him support to do that, but in the end the wrong thing was done and he's got to be accountable for that," he said.

"When events like this happen, it's a wake-up call that maybe you can do even better and I think if you don't accept that, you're not being realistic about your roles and responsibilities as parents."

After police finalise charges, the premier's son will be summonsed to face court and a minimum penalty of a mandatory 12-month loss of licence, a $463 fine and loss of 10 demerit points.

Admit it, pay the consequences, repent, and promise never to do it again and he will be a better person for it while the parents show how to become proper role models for their child.

I still don't get how this poor benz brat has mental problems yet is allowed to drive a benz over people.

I agree this is a clear-cut story of a spoiled brat who felt he could do anything to get his way. Mental problems due to poor parenting, lack of discipline. I haven't seen this mentioned in any news article given no one has yet reported on the precise nature of his mental illness, but I've seen this with other spoiled brats, that they tend to experiment with drugs, which plays a large part in the development on mental illness, such as depression and bi-polar disorders.

The fact that he was "screaming" in his room because people didn't believe he was really falling unconscious from stress... that really makes my blood boil. This guy still doesn't seem to be truly sorry for what he has done, but instead is angry because people won't sympathise with him and leave him alone.

I can't believe he even had a fan club trying to support him... for the sake of the other brats out there, he really needs to be made an example of. Unfortunately, I bet he gets off because of his mental illness... ie his doctor will provide a report stating he was not conscious of what he was doing at the time. If that's correct, you would hope some sort of criminal negligence charge would be brought against the parents for allowing him to drive.

Ratchaburi _ The banner headline coverage of a 20-year-old man who rammed his car into a crowd of people at a bus stop on Sukhumvit road early last month might call into question how and why a man with such serious emotional problems got a driving licence.

There is no easy answer to this, but the tragedy, which ended with one dead and many injured, has at least prompted transport authorities to take stricter measures on issuing driving licences.

Ratchaburi's land transport office is at the forefront of attempts to make sure any would-be driver is physically and mentally fit to drive as it is the first unit in Thailand requiring applicants to undergo health and mental checks.

The office employed an in-house doctor to run the checks from last month, shortly after the shocking incident.

Dr Jarutus Narischat, a retired doctor from the provincial health office, said the basic medical check-up on each applicant lasts about 10 minutes. During the exam, the doctor also looks for other signs of health and mental problems.

The law states that people with mental illness, mental disorders, mental retardation, alcoholism, contagious leprosy, tuberculosis, elephantiasis, and eye diseases are not allowed driving licences.

Since the scheme was launched, Dr Jarutus said he had found no applicants with psychological problems. He checks around 100 applicants a day.

The office's chief, Sucheep Wannaying, said his agency was also the first to adopt a multi-million-baht computerised system for driving tests.

The system covers optical checks and the 30-question test randomly selected by the computer. It also offers special services for illiterate people by reading out the questions to them in five languages _ Thai, English, Chinese, Japanese and Yawi.

''It's very difficult,'' said Praman Kaomodchod, 22, who was applying for a licence. The man did not pass the computerised exam.

''Thanks to our modern system, no one can cheat to obtain their licence,'' Mr Sucheep said.

Meanwhile, Banlue Thilangkoon, head of the office's driving licence section, revealed that dozens of traffic violators a month were ordered by the court to get training sessions on how to drive safely before engaging in two days of community service.

''A driver with a healthy mental condition but a lack of social responsibility is more dangerous than one who is psychologically unstable. Hence, instructions on safe driving should be taken into account too,'' Mr Banlue said.

Deputy chief Chairat Sa-nguansor said his agency together with the Medical Council, the Department of Mental Health and other relevant agencies, plans to set up a working group to check on licence applicants' health.

If the applicant fails to pass the physical and mental examination, he or she will not be allowed a driving licence.

It's quite a sad state of affairs. My understanding from the earlier interviews with police investigators were they would have completed investigations within a month... that time has expired now, and all we hear is silence... sounds like it is being swept under the carpet.

A read an interesting commentary on another site (sorry, but I forgot to record the link), which got me doing some research myself on the point, which relates to the argument of unconsciousness.

Note, the following is the legal position in common law systems. I would be interested in any commentary from someone with a knowledge of Thai criminal law. Essentially, an accused will be considered responsible for criminal acts if they possess the capacity to make rational choices to perform or refrain from doing certain acts. The accused's criminal act must have been made voluntarily and intentionally and the accused must have understood the nature of their actions. Therefore, if the accused can establish some sort of mental state that would impair the accused's ability to act voluntarily, intentionally and understand the nature of their actions, they may be excused from criminal responsibility.

Two possible categories that the Benz Brat would be trying to argue would be either a disease of the mind (commonly also referred to as the insanity plea) and automatism. Interestingly, common law courts have held that an antisocial personality disorder or psychopathy by itself does not amount to a disease of the mind and the concept is not concerned with the emotional state of the accused. Further, the ultimate decision regarding disease of mind is made by a jury, not medical practitioner. The jury will hear medical evidence, but must make its own decision as to whether the medical evidence establishes an actual disease of mind having the effect that the accused did not understand their actions, consequences etc.

With automatism, there are two possibilities, one is insane automatism (ie a disease of the mind resulting in automatism, or a total absence of control and direction of the accused's will), and the other is sane automatism, which could be eg sleepwalking, actions following a blow to the head etc.

Interestingly, for automatism, actual unconsciousness is not essential. A small degree of awareness or cognition won't necessarily defeat the defence of automatism. You will note in interviews, the police have referred to the condition of being "unconscious".

The applicable automatism argument in this case would be insane automatism. The question is whether the disease of the mind caused a total absence of all deliberate functions of the mind such that the accused acted automatically. As already mentioned above, there is already an issue as to whether or not there even is a disease of the mind, but if so, the question then is whether that particular diseas would cause a total absence. This is presumably the question the police are seeking a medical opinion on.

However, the automatism defence is defeated in a situation where the criminal act was intended or foreseen by the accused as a possible consequence of their conduct. For example, intentionally inducing intoxication is not an excuse given the potential for violent behaviour is foreseeable. In this case, the father has stated that the son was suffering from a mental illness for at least the past three months and had been receiving treatment. The effects of that illness were known. The son was aware of his condition. It is reasonable in the circumstances that both the son and parents knew that he could potentially be a danger when behind the wheel of a car.

Accordingly, irrespective of the doctor's opinion, under the common law rules, the Benz Brat would not succeed on his respective defences regarding mental illness/automatism/unconsciousness etc. Essentially, he knew of the danger that he posed behind the wheel, given his medical condition. His father has been bold enough to publicly state to the media sufficient details of his condition to draw this conclusion. He therefore loses the right to run this defence.

I would be very pleased if someone could clarify any differences in the Thai legal rules regarding the above topics.

The Pachimsawas family has yet to give any promised help or assistance to those affected by a road rage incident involving their son Kanpitak at a crowded bus stop in early July, according to the daughter of the woman who was killed.

Sucheera Insuwan said she had not been contacted by Kan-anek Pachimsawas, the father of murder suspect Kanpitak, or his divorced wife Sawinee following the funeral of her mother, Saichol Luangsaeng.

She said she expected to meet with the family tomorrow after giving them details of the damages claim.

"If my family is happy with what they pay then everything will be finished, as I have no legal knowledge and our family has suffered enough," she said.

Sucheera thought it would be an injustice if Kanpitak escaped criminal liability for the incident. It was likely, she said, his family would seek to have him declared legally incompetent in order to gain sympathy from the court and escape the murder charge.

"I have lost my mother as a result of somebody's thoughtless act. If he escapes justice I think it would be unfair to me. I would like to call on the judges to fully exercise their judgement in the most precise way they can," she added.

Hathaithip Khrutthakhajorn, who was injured in the incident, said the lawyer for the Pachimsawas family had postponed scheduled appointments with her to settle the payment of damages several times.

"It is quite clear he did everything because of his aggressiveness. I would also like to blame his parents for letting him drive, despite knowing that he was mentally sick," she said.

In the July 4 incident, a Mercedes Benz was slammed into a crowd of people who had just been ordered to alight from a bus. This followed an accident between the bus and the car and an altercation between the two drivers.

The Pachimsawas family claimed Kanpitak, who was identified by witnesses as the Benz driver, suffered from epilepsy and that he had been treated at a mental hospital this year.

Lt-Colonel Yannawut Liamkaew of Thong Lor police station said he would next week interview a psychiatrist who had treated Kanpitak. The psychiatrist had recently returned to Thailand from an overseas trip.

More than 20 witnesses to the incident have been interviewed.

The officer said he was doing his job professionally and neutrally, and although he sympathised with both parties in the case, it was up to the court to rule on whether Kanpitak's state of mind would comply with legal conditions that exempt him from criminal liability.

Sawinee pleaded for sympathy for her family, saying Kanpitak had dropped all of his university courses as he was suffering from stress and guilt. She said Kanpitak, also known as Ham, had offered to meet with those injured by his actions but they and their relatives had turned him down.

"They might not yet be ready to meet or talk with Ham," she said.

The former beauty queen said she had also been worried about Bambi, Kanpitak's younger sister who was present during the incident, because she was likely to suffer from stress if she heard anything bad about Kanpitak and it would affect her studies.

Sawinee said she had constantly been in touch with the injured victims to offer help, and that her family had not tried to interfere with the police investigation.

No agreement reached on road rage

Negotiations between the Pachimsawas family and victims of the road rage incident in early July involving their son Kanpitak who drove into a crowded bus stop failed to reach a conclusion Monday, as two victims initially demanded Bt13 million.

The case officer, Lt Colonel Yannawut Liamkaew, said the negotiations had "nothing to do" with the criminal charges of murder, attempted murder and assault against Kanpitak, which the police investigator will conclude for the Criminal Court within a week.

Further talks will be on September 14.

Prior to the negotiations at Thong Lor police station, Kanpitak's mother, a former Miss Thailand, Savinee Pakaranang, told reporters that she would talk about compensation with four more victims out the 12 affected people eight of whom had already agreed to the compensation proposed.

However, Savinee later told reporters the twohour talks did not reach any conclusion and her side wanted each victim to su bmit details of the damages claim to help her understand why they wanted such a large amount of money.

One injured victim, Sangwan Srihawong, 40, initially asked for Bt6 million, but following discussions with Sangwan's lawyer Prakobrat Dechakul - the amount was lowered to Bt3 million, Savinee said.

Sucheera Insuwan, 25, whose mother Saichol Luangsaeng, 42, was killed in the incident said the Bangkok Mass Transit Authority (BMTA) sent a lawyer to help her family seek compensation and that she initially asked for Bt7 million, which she was in process of negotiating.

"Such an amount of money can never replace my mom's life," she said, adding that the BMTA had also assisted the family by hiring her for her mother's position as a BMTA account.

Two other victims, bus driver Sathaporn Arunsiri, 37, and bus conductor Somjit Klaewkla, 35, who were both slightly injured asked for Bt70,000 and Bt73,000 in compensation respectively.

Lt Colonel Yannawut Liamkaew said if both parties could agree upon compensation, they would no longer need to file a civil lawsuit, he added.

In the July 4 incident, a Mercedes Benz slammed into a crowd of people who had just been ordered to alight from a bus. This followed an accident between the bus and the car and an altercation between the two drivers.

The Pachimsawas family claimed Kanpitak, who was identified by witnesses as the Benz driver, suffered from epilepsy and that he had been treated at a mental hospital this year.

As usual I think the correct amount of payments were made to the respective parties involved and under the agreements a hush hush clause was added.

Under Thai law for some reason if no charges are filed by the police don't take the case any further. I've seen it many times. Usually their is civil and criminal cases. under criminal cases the state is the prosecutor. But I've noticed in Thailand that the state charge very few. Let's say someone was murdered. If the deceased relatives don't file their case the police just wrap up the investigation and close the case.

This happened to someone I knew. He was selling stir fried noodles in Yaowaraj. One day he was robbed and murdered for his priceless amulet. He had no wife or relatives. The police didn't investigate further because no one filed on his behalf. There wasn't any pressure to catch the criminals. Very very sad.

I personally filed a case for one occassion due to someone writing me a bad check. Believe it or not a bad check is considered a criminal crime. I went to one police station, they said no, I had to file at another police station near the bank of the actual check. The officer in charge delayed and delayed time and time again.
Excuses for every visit:
1) It is too early to press charges, please come back later.
2) Today I'm busy, please come back later.
3) I lost the files so please come back later after I find them.
4) File a report with my assistant today and come back later.
5) I'll give the defendant some time first while I try contact him then come back.
6) I write a letter (supoena) to contact him and ask him to come to the station.
7) Under law two notices have to be sent so please come back again.
8) Notices have been sent and unreplied but have to check with the bank to make sure the crime actually took place and the check was really bad. Duh?

Eventually I just said hell with it and eventually got the money through other channels.

At no time did I make gifts or payments to this guy. I wanted to but I wanted to wait until something actually got done first which it never did.

I hate the police more and more every day. These guys spend their time on people's money repaying other people's services and doing favors for people with lots of money and clout. The lower class officers make their meat from truckdrivers and motorcycles. Just check out the traffic they cause before the end on the month when their payments are due.

These people in brown uniforms have no idea on how to catch actual criminals.

Road rage trial set for March 24

Kanpithak Patchimsawat, the young man who ran his Mercedes into a crowd at a bus stop in July last year, killing one person and injuring several others, was yesterday indicted on three charges, including murder. Mr Kanpithak, also known as Mu Ham, was indicted on charges of murder, attempted murder and physical assault.

He pleaded guilty to the assault charge, but denied the others.

The 20-year-old son of former Miss Thailand Sawinee Pakaranang and nephew of retired assistant police chief Pol Lt-Gen Ukrit Patchimsawat comes from a wealthy and influential family.

In the motion, the prosecutor said Mr Kanpithak got into an argument with a bus driver, hitting the man in the face with a brick, before driving his car into a crowded bus stop, killing 42-year-old Saichon Luangsaeng and injuring several others. The court scheduled the trial for March 24.

Mr Kanpithak apologised yesterday for the harm he had caused ''unconsciously'', before bursting into tears. His family have claimed he was suffering from mental problems.

'Mu Ham' in trouble again on the roads

Kanpithak Patchimsawat, who gained notoriety for lethally driving his car into a bus passenger queue, was involved in another altercation with a bus yesterday.

Mr Kanpithak, also known as Mu Ham, grazed a public bus with his sedan in Wang Thonglang district, a repeat road offence that could see his driver's licence revoked for life.

The incident happened on Lat Phrao road in front of Chokechai Si market near Soi Lat Phrao 55/2. No one was hurt.

The 20-year-old son of former Miss Thailand Sawinee Pakaranang was driving a Honda Accord when he scraped the side of a No 545 bus, which travels between Samrong and Nonthaburi.

He told traffic police who responded that he knew high-ranking police officers.

The man is a nephew of retired assistant police chief Pol Lt-Gen Ukrit Patchimsawat.

Later, his father, Mr Kan-anek, arrived and agreed to pay the bus driver 2,000 baht for repairs.

Mr Kanpithak is free on bail of a million baht after driving his Mercedes into a crowd at a bus stop in July last year, killing one and injuring several others.

He had argued with the driver of bus No 513, accusing him of damaging his car, while in the Asok area. He hit the man in the face with a brick and then gunned his car into the passengers who had descended from the bus.

Just last Thursday , he pleaded guilty in court to assault and denied two other charges, murder and attempted murder. The court scheduled the trial for Monday.

Pol Col Jirapat Phumijit, Thong Lor police chief, who handled the case, said Mr Kanpithak's driver's licence is still valid. Because of the three serious charges, police did not bring ''weaker'' charges, which would immediately have suspended his licence.

''This new incident is deemed as a repeat offence. It is now up to the court to rule whether to revoke his driving licence or to ban him from driving for good,'' Pol Col Jirapat said.
