It seems to be very odd that those intellectualls have turned the blind eyes toward corrupt politicians are the causes of all troubles today since they never changed theri nature of pure greed.

Furthermore, they use very agressive words to REJECT the constiution outright while the Junta had been more flexible for the referendium. This is clear sign that thsoe intellectuals are riding the back of tigers .... not just the Junta as they claim.

If the BE 2550 Constitution has passed the referedium, those intellectual would have to face humiliation and they will be reminded that they ride the back of tiger so they are fighting for the lost cause to disapprove the constitution.

Only to be expected from the reactionaries at Matichon and The Manager I suppose. However, I have to agree that the left-wing cause has gained nothing from allying itself with intellectuals and dodgy ex-policemen who appear to favor a highly strategic approach to subverting the current dinosaur elite. Especially since, I'm convinced that the Thaksin plan will do nothing more than supplant one tyranny (perhaps intentionally) with another. The local electorate do not appear to understand such strategies; or perhaps, like me, they are genuinely suspicious of the intent of such machiavellian approaches. Indeed these strategies are so convoluted that they make it almost impossible to portray genuine social justice issues as viable alternatives to the status quo. Perhaps this is why the international community seems genuinely perplexed as to what is happening in Thailand, since their own history suggests that that progress is usually achieved from a rather slow but steady form of direct confrontation.

It is also somewhat ironic that many slightly left-leaning people are capable of admitting that the aristocracy are always with us, but that they can actually be coerced into a slightly more benign outlook on their own society. All I hear from the likes of the PTV/UDD/DAAD crowd is a bunch of garbled nonsense about overthrow. Not only do I think this sounds extremely naive, I would definitely question whether their real intention is to create genuine social progress or just to usher in a society in which they gain the privileges they believe the rest of us owe them.

However, I can't leave off here without throwing at least one brick at the elite. I want to say that this crisis is where the violent suppression of radical politicians in the past has inevitably lead us. Having killed off most of those people who had an interest in achieving societal change through practical means, we are left with a conniving and dishonest bunch of fanatical monomaniacs. If you kill off the alternative agenda in a ruthless manner, you shouldn't be too surprised that the survivors of that atrocity display a more ruthless, scheming and impractical nature.

Court to consider Thaksin's suit on Finland Declaration
The Criminal Court accepted on Thursday a criminal libel case from deposed premier Thaksin Shinawatra filed in June 2006 in relation to public comments about the socalled "Finland Declaration".

His opponents named in the suit had alleged Thaksin and his close aides had examined ways of holding on to power in a plot deemed offensive to the monarchy.

Thaksin named 10 individuals as having defamed him. Key defendants include anti-Thaksin campaigner Sondhi Limthongkul, Chirmsak Pinthong, Chaianan Samudvanija and Pramote Nakornthap.

The first hearing will be held on December 11.

Groups 'bid to topple monarchy institution'

Three separate groups have been attempting to topple the institution of the monarchy, according to the findings of a panel appointed by National Legislative Assembly (NLA) chairman Meechai Ruchupan.

According to an NLA source, the panel's report says the first anti-monarchy group has been using the public stage to debate whether the institution of the monarchy should continue to exist. The group was critical of the monarchy and spread its opinions through articles and research, and presented the idea of imposing checks on the monarchy.

The second anti-monarchy group is anonymous and carries out its campaign through websites registered abroad. It aims to attack individuals more than the institution, criticises behaviour, publishes unsuitable pictures and distorts facts.

The third group seeks to abuse the institution for self-interest and political reasons.

Meechai instructed the 23-member panel, headed by NLA member Sompot Kanchana-porn, to study ways to tackle national problems through legislation, particularly the four reasons cited by the coup makers for overthrowing the Thaksin Shinawatra government.

One of the justifications the the coup makers gave was activities deemed to be lese majeste.

The panel's report showed statistics from the Metropolitan Administration that recorded 20 lese majeste cases from December 2004. Six cases were dissolved, the prosecutor dropped one case, police dropped one case, six cases are under police investigation, two cases are under National Police Commission investigation, three cases are being forwarded to the National Police Commission and one case is under the consideration of the Special Branch Police Bureau.

The panel suggested three solutions to prevent anti-monarchy activities: setting the issue as a national agenda and appointing a panel to be in charge of such offences, ensuring the National Police Commission strictly enforces the law, and promoting the image of the monarchy institution, especially by creating understanding with the international community.

The panel also suggested changing the criminal law on offences relating to the King, the Queen, heir to the throne and governor-general. The panel proposed to insert a clause in Article 112 of the criminal law that covers offences against the monarchy institution to include offences against representatives of the King and the King's sons and daughters. Those who violate the law would be punishable by up to seven years in jail and a fine of up to Bt140,000.

The panel also proposed a law amendment to allow police and judges to ban publicity or criticism or comment on lese majeste cases in any media. Those who violate the ban would face three years' imprisonment and a Bt60,000 fine.

The panel also proposed to amend the law involving computer offences to include a national security threat and to allow courts to ban the dissemination of defamatory information about the monarchy through websites.

FORMAT:

Small group deliberation in simplified mock-trial format; class is divided into three groups for mock trial; groups of three, one each acting as judge, accused and accuser, for review discussion.

BACKGROUND:

A full-scale mock trial can be an intimidating prospect for an elementary classroom-both for teacher and students. This lesson plan for a simplified mock-trial provides an opportunity to experience the fundamentals of a trial.
Beginning with a cast of three characters, students will develop skills that will lead them safely into more complicated cases. The basic tenets of the lesson include those items covered in the learning objectives. Understanding that the purpose of a trial is to settle a dispute between two people, the two parties are given an opportunity to present their side of the story to a judge. Why doesn't Thailand have a no-confidence vote formality? It's not as if the issues facing the country are unique...every country has corruption, an army, and groups trying to get in, and a divided populace. Every year or 6 months or so, a PM should be held up to a vote, and if he fails, a new PM must be elected. Thailand's problem isn't corruption, nor the change of power, but how smooth that transition is. Someone will rob the people anyway, the people just get to choose who. If people get upset and throw out someone for corruption, there just will be another to take his place. Tanks may do less damage than laws, but they freak people out more. In other words, Thailand needs image control. If people don't trust the PM's, they should have votes more often. People forget that the goverment has many workers, and can still do good despite a corrupt man at the top. Stability will bring the prosperity in a global economy, even without a good PM...

I don't have a legal or political science background, so I may have got the wrong end of the stick. I seem to remember two or three 'no confidence debates' in parliament during the Thaksin era. Needless to say he won them all through sheer dint of numbers. Over the years, I have probably seen about 10 such debates on TV, as they are televised live, often run until the early hours of the morning and do actually attract considerable public interest. Indeed, I believe such debates played a significant role in the replacement of 'Mr Eel' PM Barnharn & 'Big Jiew' PM Chaovalit.

Really interesting stuff. Thought provoking lessons such as the one discussed are crucial for the development of critical thinking and understanding in Thailand's youth. It seems sorely lacking in their 'grown up' counterparts. Get this practice firmly embedded at this age and perhaps in 20 years time we won't have politicians chickening out of open debate (q.v. Samak's response to Abhisit's invitation) and the public will be better placed to demand more of their representatives than defamation law-suits and childish mudslinging.

I do however think your are on the right track regarding Thaksin and the communists - he is prepared to use them for the time being, just like they are prepared to work with him to achieve their goals.

In effect, both are holding their noses for the time being, to knock out the royalists, then they can face off against each other at a later date.

All this could be avoided if the monarchy could bring itself into the 21st century (like various European monarchies), truly stay out of politics, be transparent in their financial dealings, pay taxes, disband the puu yai network, reform the military (reduce the generals would be a good start) etc.

Basically the whole 'system' is corrupt, and the reform can either come from the top down, or from the bottom up - the latter will be more violent and messy, with a more uncertain outcome.

It's going to happen sooner or later, and the monarchy stand more of a chance of coming out of it with a reasonable reputation if they start the process themselves, rather than have it forced on them.

We NEVER really welcome those Armed Forces officers who are subordinates of the Politicians who hope that their Army men will be protectors of their political thrones FOREVER. Those kind of officers are considered as the sabotagers of the Military Institutes since they are "the 5th column" as well as "Enemies WITHIN" ion the eyes of Army men.

7. Never pick up Army officers to be Aide de Camps of the politicians. ONLY Prime Ministrer and Minister of Defence have right to get Aide de Camps and Aide de Camps have to wear uniforms when they are on DUTY ...
